NM's Gun Confiscation Law will cost innocent lives
Democratic Governor signed an egregiously unconstitutional bill into law earlier this week.
New Mexico’s new gun confiscation law is now the most extreme “red flag law” in the nation, and it requires sheriffs to violate their oath to the Constitution.
Gov. Michelle Lujan Grisham says those sheriffs who refuse to enforce it should just resign.
What an insult our brave men and women in law enforcement!
Red flag laws allow a judge to take away any citizen’s Second Amendment rights immediately and single-handedly. This is not how the rule of law works in America.
As Judge Andrew Napolitano says:
“The concept of a ‘red flag’ law… violates both the presumption of innocence and the due process requirement of proof of criminal behavior before liberty can be infringed.”
New Mexico sheriffs are the ones who will bear the cost of any litigation against enforcement of unconstitutional laws that violate the Second Amendment. Law enforcement will put their lives in danger to carry out gun confiscation orders.
Neither the governor nor Democratic lawmakers will be the ones knocking down doors in the dead of night and taking the guns away.
That will be the job of our brave men and women in law enforcement.
As New Mexico’s U.S. Senator, I will fully support local officials’ refusal to enforce an unconstitutional law and will oppose any attempts to infringe on our constitutional rights.
I proudly stand with the New Mexico sheriffs who take their oath to the Constitution seriously.
